State of Jammu & Kashmir
Since the Jammu & Kashmir Assembly approved the Instrument of Accession signed by Maharajah Hari Singh in 1954, the plebiscite issue has long since been resolved. This letter was addressed by JP to the editor of the Indian Express on 5.5.2000 and refers to Saeed Naqvi’s article, “The Lie across the Border” (March 24, 2000). It’s true that India has traditionally handled the Kashmir dispute poorly. There is a lot more to Kashmir than merely a majority of Muslims. The Kashmiris are Indian.
Aspect of contiguity
In actuality, the argument of “contiguity” is unconvincing. Should India attempt to seize Bangladesh since it is adjacent to West Bengal? Afghanistan and Pakistan’s North West Frontier Province are adjacent. Is it something the Taliban should claim?
Therefore, Pakistan’s reasoning and the Kashmir issue are incompatible with international law and agreements. Pakistan will never be able to include Kashmir. Sunnis make up barely 2% of the State of J&K’s land area, although making up 22% of the population.
In addition to being long dead, the plebiscite issue is illogical. When Kashmir joined India, Nehru insisted that the Kashmiri people support Maharaja Hari Singh’s actions.
Kashmir has its own laws and Constitution, in contrast to other Indian states. As a result, in 1951, the people of J&K elected a Constituent Assembly. Additionally, the Rajah of Kashmir’s signing of the Instrument of Accession to India was permanently approved by the Assembly of Kashmir in 1954.
Plebiscite
Nehru approved the plebiscite plan under U.N. auspices. for the state of J&K, provided that Pakistan removes its soldiers and leaves the area of Kashmir that it unlawfully occupied (PoK). As long as Pakistan retains PoK, the Plebiscite issue does not come up.
